Who still qualifies for a spousal open work permit in Canada—spouses of eligible students and foreign workers, TEER rules, 16-month validity, documents, and the sponsorship AOR route. RCIC guidance.
Spousal Open Work Permit (SOWP) in Canada: Students, Foreign Workers & Sponsored Partners
A spousal open work permit lets an eligible spouse or common-law partner work for almost any employer in Canada (subject to standard restrictions). It is not automatic for every student or worker family.
Since 21 January 2025, IRCC has narrowed who qualifies when the principal person is a student or a foreign worker. A separate open work permit route exists for many people being sponsored for permanent residence after IRCC issues an Acknowledgement of Receipt (AOR).
Confirm eligibility on the live IRCC pages before you apply—lists and conditions can change.
Key takeaways
Not every international student’s or foreign worker’s spouse qualifies.
Students: generally master’s 16 months or longer, doctoral, listed professional degrees, or certain eligible pilot/bridging programs—not most college or bachelor programs.
Workers: generally TEER 0 or 1, or a selected TEER 2/3 occupation on IRCC’s list, with enough remaining work authorization (often at least 16 months when IRCC receives the spouse’s application).
Sponsored spouses/partners in Canada may use a different OWP path after AOR on the permanent residence file.
Genuine relationship evidence is required on every route.
Duration is usually aligned with the principal applicant’s status; plan renewals when the student moves to a PGWP or the worker’s permit is extended.
1. SOWP when your partner is an international student
Your spouse or common-law partner may be eligible for an open work permit if you hold a valid study permit and you are in one of the situations IRCC lists, including:
A master’s program of 16 months or longer
A doctoral program
A listed professional degree at a university (examples IRCC publishes include medicine, dentistry, law/JD, optometry, pharmacy, veterinary medicine, certain nursing degrees, education, engineering)
Certain eligible programs IRCC names (e.g. specified Francophone or health-related pilots—confirm the current table on canada.ca)
Usually not enough on its own: college diplomas, most bachelor’s degrees, short master’s programs under 16 months, and certificate programs.
Duration
Often matched to the study permit. When the student transitions to a PGWP, the spouse typically needs a new assessment under the worker rules (TEER + remaining validity), not the student rules alone.
→ PGWP for International Students
Core documents (typical)
Proof of relationship (marriage certificate or common-law evidence / IMM 5409 as applicable)
Proof of enrollment in an eligible program
Copy of the study permit (and related status documents as required)
2. SOWP when your partner is a foreign worker
Under the general measure for family members of workers (not relying on a separate PR-tied measure), eligibility is usually limited to the spouse or common-law partner (dependent children are generally not eligible for new permits under the tightened rules).
The foreign worker typically must:
Hold a valid work permit (or be approved for one), including many employer-specific or open permits in eligible categories
Work in TEER 0 or 1, or a select TEER 2 or 3 occupation on IRCC’s published list
Have work authorization that remains valid for at least 16 months beyond the date IRCC receives the spouse’s open work permit application (timing matters—do not wait until the permit is almost expired)
Be living and working in Canada, or clearly planning to, as required by the instructions
Family member must meet general work permit requirements and prove a genuine relationship. Applications from inside Canada usually need valid temporary status, maintained status, or eligibility to restore.
Exceptions / other measures
Some situations follow different instructions, for example:
Certain free-trade or agreement-based work permits
Workers tied to an economic-class permanent residence application (proof such as AOR / stage approval, as IRCC requires)
Time-limited or project-specific public policies
Those are not the same as the general “high-skilled worker spouse” test, match the correct IRCC instruction set.

→ Work Permit to PR: Guidance for Workers Already in Canada
→ Bridging Open Work Permit (BOWP)
Core documents (typical)
Relationship proof
Worker’s permit / authorization and remaining validity
Evidence of occupation (employer letter, offer, NOC/TEER)
Status documents if applying from inside Canada
3. Open work permit when you are being sponsored for PR
This is a different route from “spouse of a student/worker.”
If you are a spouse, common-law partner, or conjugal partner living in Canada and being sponsored for permanent residence, you may apply for an open work permit when, among other conditions:
The relationship is genuine
You are included in the PR application and have an AOR confirming the PR application is in process
You are living in Canada with your sponsor
Limited rules may allow filing without AOR only in narrow cases (e.g. status expiring within about two weeks and a PR application under the applicable spouse/partner class already submitted)—confirm the live IRCC text before relying on this.
Documents: what officers expect
Incomplete relationship evidence and wrong program/TEER assumptions are common refusal drivers.
Practical planning points
Map the principal person’s status first (study program length, TEER, permit expiry).
File the spouse’s OWP while enough validity remains on the worker’s permit when the 16-month rule applies.
PGWP transition: reassess under worker rules; student-based SOWP does not automatically continue.
Inland status: do not let the spouse fall out of status while waiting.
PR strategy: an OWP is temporary authorization—it is not permanent residence. Coordinate with Express Entry, PNP, or sponsorship where relevant.
FAQ
Can any international student’s spouse get a SOWP?
No. Eligibility is limited to partners of students in programs IRCC lists (e.g. longer master’s, PhD, specified professional degrees, certain pilots).
Can any foreign worker’s spouse get a SOWP?
No. Under the general rules, TEER and remaining permit validity (often 16 months) matter. Lower-skilled occupations without an eligible exception usually do not qualify for a new SOWP.
Does a SOWP let me work for any employer?
Open permits are broadly flexible but still subject to IRCC conditions and Canadian law. They do not authorize work that requires separate licensing where regulated.
What if we are in a sponsorship process?
Use the sponsorship OWP rules (AOR, living with sponsor), not only the student/worker family measures.
Can Mapleaves help if our first SOWP was refused?
A review can identify whether the refusal was program/TEER/timing/evidence-related and what lawful options remain.
