SOWP eligibility for student and worker spouses: program rules, TEER/NOC occupations, eligible jobs, 16-month timing, and documents — updated for post-January 2025 requirements.

Spousal Open Work Permit (SOWP) Canada: Eligibility for Spouses of Students and Workers

A Spousal Open Work Permit (SOWP) can let a spouse or common-law partner work for almost any employer in Canada while the principal applicant studies or works. Since 21 January 2025, eligibility is much narrower than many families still assume.

This page explains who still qualifies, what evidence IRCC expects, and where timing mistakes cause refusals — for spouses of international students and foreign workers.

Key takeaways

  • SOWP is not available for every student spouse or every worker spouse.

  • Student side: mainly master’s (16+ months), doctoral, listed professional degrees, or named pilots — not most college or bachelor programs.

  • Worker side: TEER 0 or 1, or selected TEER 2/3 occupations, plus enough time left on the principal’s permit (generally 16 months at filing, with limited exceptions).

  • Relationship genuineness and the principal’s actual status/enrolment/occupation drive the file.

  • PGWP holders are assessed under worker rules, not student rules.

What a SOWP is (and is not)

A SOWP is an open work permit tied to a spouse or common-law partner’s eligible study or work status. It is not a permanent resident document and not a guarantee that every family member can work.

If you are not eligible for a SOWP, other options may still exist (employer-specific work permit, separate study permit, visitor status, or a different family strategy). Eligibility should be checked before you file.

I. SOWP for spouses of international students

Who can apply (rules in force since 21 January 2025)

The principal applicant must hold a valid study permit and be enrolled in an eligible program, typically:

  • a master’s degree program of 16 months or longer, or

  • a doctoral degree program, or

  • one of the listed professional degree programs at a university (for example medicine, dentistry, law/JD, pharmacy, optometry, veterinary medicine, certain nursing degrees, education, engineering — confirm the current IRCC list before filing), or

  • a named eligible pilot / special program published by IRCC (e.g. certain Francophone or healthcare recognition pilots — lists change; verify on Canada.ca).

Generally not eligible under the student-spouse SOWP rules: most college diplomas, certificates, many bachelor’s programs, and master’s programs shorter than 16 months.

Duration

In most cases the SOWP is aligned with the student’s authorized study period. When the student moves to a PGWP, the spouse often needs a new assessment under worker SOWP rules (TEER + time remaining), not an automatic extension of the old student-based SOWP.

Evidence (student pathway)

  • Proof of genuine relationship (marriage certificate or IMM 5409 + supporting cohabitation evidence as applicable)

  • Proof the student is in an eligible program (enrolment letter stating program type and length)

  • Valid study permit / status documents for the student

  • Identity and standard work-permit forms/requirements for the spouse

II. SOWP for spouses of foreign workers

Who can apply

The principal worker generally must:

  • be authorized to work in Canada (valid work permit or approved permit in the relevant scenarios IRCC allows), and

  • work in TEER 0 or 1, or a selected TEER 2 or 3 occupation on IRCC’s list, and

  • have a permit validity that meets IRCC’s minimum remaining duration rule at the time of the spouse’s application (commonly framed as at least 16 months remaining, with specific exceptions such as some concurrent PGWP filings — confirm current instructions).

Open work permits in non-family categories, employer-specific permits, and certain economic-class / pilot permits can support a SOWP if occupation and duration tests are met.

Family members

SOWP in this context is built around the spouse or common-law partner. Do not assume dependent children automatically receive the same open work authorization under the post-2025 framework; check current IRCC rules for children separately.

In-Canada status

If the spouse applies from inside Canada, they must have valid temporary resident status, maintained status, or be eligible for restoration where applicable. Status gaps should be fixed or planned before relying on SOWP processing times.

Evidence (worker pathway)

  • Relationship proof

  • Principal’s work permit / authorization

  • Proof of occupation and TEER/NOC (employer letter with duties, NOC, employment terms; offer letter where relevant)

  • Proof of sufficient validity remaining on the principal’s permit (unless an exception in the instructions applies)

  • For some FTA or PR-transition cases, additional proof of the principal’s stream (as listed in IRCC instructions)

PGWP note: A PGWP holder’s spouse is usually assessed as a worker’s spouse (TEER + duration), not under the student program list.

SOWP-eligible occupations, jobs, and NOC codes (worker pathway)

Eligibility is not a single static job title list for every case. IRCC ties the worker-spouse open work permit to the principal applicant’s skill level and occupation classification:

  1. TEER 0 or TEER 1
Management and professional occupations under NOC 2021. If the principal’s duties and NOC correctly fall in TEER 0 or 1, the occupation side of the test is usually met (duration and status rules still apply).

  2. Selected TEER 2 and TEER 3 occupations
Only specific NOC codes published by IRCC qualify—not every TEER 2 or 3 job. “Eligible jobs” in this band means on IRCC’s current select list, not “skilled-sounding” work in general.

  3. What officers check in practice

    • NOC/TEER on the permit, offer, or employer letter

    • Whether main duties match that NOC

    • Whether enough validity remains on the principal’s work permit at filing

    • Genuine relationship and the spouse’s own admissibility/status

How to verify a NOC before you file

  • Identify the principal’s main duties (not only the job title).

  • Find the matching NOC 2021 code and TEER.

  • If TEER 2 or 3: confirm the code is on IRCC’s current list for spouse/partner open work permits.

  • Do not rely on old blog lists or a friend’s approval from a different year.

A wrong NOC or inflated title is a common refusal pattern: the job may be real, but it is not an SOWP-eligible occupation under the rules that apply to your file.

Student-spouse SOWP does not use this TEER/NOC test; it uses the eligible study program list instead.

III. Common refusal and timing risks

These are the files that benefit from a structured check before submission, not only form-filling.

IV. How Mapleaves can help

SOWP is often treated as a simple family add-on. After 2025, it is an eligibility and evidence problem: program lists, TEER, permit expiry, and transition from study to PGWP.

We can help with:

  • eligibility screening (student list vs worker TEER rules)

  • document strategy and consistency across forms

  • timing when the principal’s permit or program end date is close

  • in-Canada status issues linked to the SOWP filing

  • next-step planning if SOWP is not available

                   FAQ

What does SOWP mean in Canada?
Spousal Open Work Permit — an open work permit for an eligible spouse or common-law partner of certain students or workers.

Can every international student’s spouse get a SOWP?
No. Since 21 January 2025, eligibility is limited mainly to spouses of students in longer master’s, doctoral, listed professional university programs, or named pilots.

Can a PGWP holder’s spouse get a SOWP?
Possibly, under worker rules (occupation/TEER and remaining validity), not under the student program list alone.

Is common-law accepted?
Yes, if you meet IRCC’s common-law definition and can prove the relationship.

What if we are not eligible?
Consider employer-specific work permits, study options for the spouse, visitor status, or longer-term family/economic PR strategy — assessed case by case.

What NOC codes are eligible for SOWP?
TEER 0 and 1 broadly; TEER 2/3 only if the NOC is on IRCC’s select list. Confirm the current list and that duties match the code.

What jobs are eligible for a spousal open work permit?
Jobs that correctly map to an eligible TEER/NOC for the worker pathway, or where the principal is in an eligible study program for the student pathway.
